Walton man sentenced for death of girlfriend's baby
BOONE COUNTY, Ky. (WKRC) - A judge sentenced a man to 20 years in prison for killing his girlfriend's baby. Cody Phelps had pleaded guilty in September.
Aiden Wainscott, the son of Phelps' girlfriend at the time, was found unresponsive in his crib in November of 2015. He had severe head injuries and several broken bones. The 7-week-old baby was pronounced dead shortly after arriving at the St. Elizabeth Hospital.
Phelps' attorney told the judge he'd spent a lot of time with his client. "He's certainly not a monster. He's a young man who was probably in a situation he wasn't prepared for. There was a tragic circumstance, a tragic outcome and he's going to pay the price for it."
The baby's family did not speak in court. They had submitted victim impact statements.
Judge Richard Brueggemann said he found the facts of the case troubling. "It's beyond this court's ability to imagine how a child that young could be put in a situation he was by any adult, regardless of one who was close to that child. Children need to be protected."
The judge also told Phelps, "I do hope, if you have it yet, you do find remorse."
The 20-year sentence was negotiated ahead of time as part of Phelps' guilty plea.
