Hospital Prevents Transfer for Brain Dead Teen

OAKLAND, Calif. (WKRC) -- The future of a 13-year-old girl declared brain dead after a Tonsillectomy is once again tied up in the courts.
The hospital treating Jahi McMath is unwilling to allow an outside doctor to fit the teen with the breathing and feeding tubes that would allow her to be safely transferred to another facility.

Lawyer Douglas Straus said Tuesday that Children's Hospital Wakland would not permit the procedures on its premises because Jahi McMath is legally dead in the view of its doctors.

A state court refused to hear the family's request to have the tubes installed saying the matter must first go before a lower court.
