Couple files suit against Ohio gay marriage ban

CINCINNATI (WKRC) -- A lawsuit filed in federal court seeks to overturn the ban on same-sex marriage in Ohio.

A gay, married couple filed the civil rights suit in Cleveland.  The two men married in New York in 2012 and have a 7-year-old adopted daughter.  They've been a couple for 28-years and argue they've been denied a family plan under the new health care law because of the ban on same-sex marriage.

Their argument is similar to those used in cases in other states where judges declared same-sex marriage bans unconstitutional.
