Gunman in deadly shooting claims self-defense

NORTHSIDE, Ohio (Larry Davis) -- 41-year-old David Wheeldon was shot and killed following a confrontation with another man.

Officers found his body at about 6:30 Sunday night near the corner of Chase and Cherry Streets in Northside.  So far, no charges have been filed in the case.  Police turned it over to the prosecutor's office to present to the Hamilton County Grand Jury.

Local 12 has learned the man who fired the gun is claiming self defense.  But the victim's wife says no way.

Lena Wheeldon will never forget what she witnessed Sunday evening, "My husband get shot in the face, and die."
   
Wheeldon says she watched from her Cherry Street home as her husband was shot to death.  Earlier, she called police asking that they remove David Wheeldon from their home.  She says he had been drinking and got into an argument with their 14-year-old son.  That fight ended in the street, when she says a passerby intervened.

"My husband told him to mind his f-in business and he pulled the gun out and shot him right in the face.  In my opinion that was like, he meant to kill him because he could have shot him in the leg or in the arm, anything like that.  But they shot him straight in between the eyes," Wheeldon said.
   
A Cincinnati Police officer, responding to Wheeldon's call for help, arrived on the scene seconds after the deadly shot.  Several other people witnessed the shooting.  One of them told Local 12 News off-camera Monday that she agreed the gunman acted in self-defense.
   
Lena Wheeldon says her husband had a lengthy criminal record.  But she's adamant he did nothing to warrant being shot.

So far, police have not released any information about the man who fired the deadly shot.  For now, he's in limbo as a grand jury looks at the case.  The shooting happened right by Mckie Recreation Center and Chase Elementary School.  Detectives say several witnesses provided them with good information.
