Family files lawsuit in taser death

HAMILTON COUNTY, Ohio (WKRC) -- The family of Gary Roell filed a federal civil rights and wrongful death suit claiming Hamilton County sheriff deputies unreasonably tased Roell who suffered from mental illness.

Officials said a sheriff's deputy's use of a taser on the man was warranted.  59-year-old Gary Roell died after the taser was used on him in August of 2013 at a condo complex in Sycamore Township. 

When police attempted to arrest him, they say he punched one of them in the face.  That was when they shot him with a taser in the chest and upper back.  Deputies said he went unconscious after he was hit with the taser. 

Roell's family said he suffered from a mental illness, and had quit taking his medication.

Attorneys acknowledged some upgrades have been made in policies since Sheriff Neil took office, but maintain much more work remains to be done.
