CINCINNATI (WKRC) - A judge ruled on how the $4.85 million settlement in the death of Sam DuBose would be divided on May 23. The University of Cincinnati settled with the family after former UC police officer Ray Tensing shot and killed DuBose during an off-campus traffic stop in 2015.

Nineteen attorneys representing more than a dozen family members fought over the money during several court hearings.


DuBose has 13 children, seven of whom are adults. Attorneys for the younger children argued that the kids deserve a larger portion of the money. Judge Ralph Winkler agreed, assigning each of the 13 $217,816.

Judge Winkler gave DuBose's mother, Audrey, $90,000. His father will receive $25,000. DuBose's six siblings will receive $32,000 each. When asked if he was happy with his amount, brother Aubrey DuBose said, "It is was it is. Justice was served. That's not a big deal. My thing is that a lot of truth got left out". He did not elaborate.

An attorney for one of DuBose's children, Konrad Kircher, says he hopes this settlement helps the family. "Everyone needs closure, everyone needs the healing. I think this is the opportunity now, the judge set the right tone for that."

Those involved had a thirty-day window if they wish to appeal. They may appeal their amount but not the entire settlement.
